You agree to accept and be bound by these terms and conditions by accessing the website and/or placing an order for the purchase of jewellery. Regardless of whether or not you choose to register with us or place an order with us, you confirm your acceptance of these terms and conditions upon use of the website.
• “Jewellery” means the jewellery that is predesigned or jewellery set with Cubic Zirconia and/or other synthetic coloured stones that are available for sale on our website. Please note that all Jewellery is sold on an “as is” basis.
• You can access most pages of the website without registering your details with us. Certain areas of the website are only open to you if you register.
• Please read and familiarise yourself with these terms and conditions. If you do not accept them, please do not use the website.

4. Eligibility

4.1. You shall use the website only if you are competent to enter into a legally binding contract under the provisions of the Indian Contract Act, 1872. If you are a minor and wish to purchase jewellery through the Website, you may do so through your legal guardian or parents who have registered themselves as Registered Users of the website. The website reserves the right to terminate your membership without assigning any reason.

5. Your Online Order/Payment

5.1. You accept that upon ordering “jewellery” online from this website, you are deemed to have placed an order with www.supernova-jewellery for the purchase of the specified jewellery. You recognise that you can purchase jewellery through the website only through your membership, guest, or user account. All online payments will be accepted only through valid and authorised credit/debit cards, net banking, or any other mode specified on the website. The website’s Secure Sockets Layer (SSL) technology will encrypt all registered data, including your name, address, credit/charge/debit card (“Card”) details, and telephone number, and help ensure the security of online transactions made on the website.

5.3. The website reserves the right to refuse to process a transaction for any reason or refuse service to anyone at any time at its sole discretion. The website shall not be liable to you or any third party for withdrawing any jewellery from the website, whether or not that jewellery has been sold.

6. Delivery

6.1. Once you have made a valid online purchase of jewellery from the website and payment has been received for the product price and location-based delivery charges, if applicable, the website will send a confirmation email to your registered email address informing you of the scheduled delivery date of your jewellery.

6.2. The website will make every effort to carry out deliveries within the stated time period. The delivery time period given to you is an estimate provided in good faith. If the website subsequently finds that the estimate is inaccurate, it will endeavour to inform you using the contact number and/or email address included in your Registered Data.

6.3. If your purchased jewellery remains undelivered for more than one week, either due to your or the recipient’s unavailability or any other reason not attributable to www.supernova-jewellery, www.supernova-jewellery reserves the right to claim charges, including levies incurred by www.supernova-jewellery, before delivery or redelivery of the product.

6.4. All purchases of jewellery made by you from the website are pursuant to a shipment contract. You agree that title to the purchased goods shall pass to you once the goods are delivered by the website to the carrier for delivery to your doorstep. You agree that the carrier of the purchased goods to your premises shall be your agent.

7. Jewellery Measurements, Size and Appearance

7.1. Some items may appear slightly larger or smaller than their actual size due to screen settings and photography techniques. Items may sometimes be represented as larger than their actual size to clearly show details or smaller than their actual size to show the entire item. The Company shall not be liable for any legal action on this account. supernova-jewellery makes all reasonable efforts to display the products listed for sale on its website as accurately as possible. However, supernova-jewellery cannot guarantee that your monitor’s display of any product colour, texture, or detail will be accurate. supernova-jewellery does not warrant that product descriptions or other content are complete, reliable, current, or error-free.

8. Short Delivery, Defective Goods or Damaged Goods

8.1. The recipient accepting delivery should carefully examine the delivered package and shall not accept deliveries where the packaging has been tampered with. The customer is also required to make a single, uncut video while unboxing the package that clearly shows any missing product, missing part, or damage to the product to lodge a complaint regarding receipt of a defective product or an empty box/package.

8.2. Upon signing the delivery receipt, the recipient acknowledges receipt of the product in accordance with the order placed with the Company. The Company is not liable to the Customer/recipient for any refund or replacement, under any circumstances, for any subsequent complaints regarding such deliveries.

8.3. The website does not warrant coverage for the effects of normal wear and tear or damage caused by accident, movement, abuse, or neglect of the purchased jewellery at your end.

9. Coupons and Promotions

9.1. supernova-jewellery has the right to refuse the use of any promotional code or coupon at any time. Promotional codes that have expired cannot be used on the Website.

9.2. supernova-jewellery may ask the Member at any time to provide proof of having received the promotional code or coupon.

9.3. Promotional codes and coupons may be used only on specific orders as deemed appropriate by supernova-jewellery.

9.4. The applicability of promotional codes or coupons to certain items, specific orders, dates, or occasions is at the discretion of supernova-jewellery.

9.5. Promotional codes and coupons cannot be combined with any other special offer on the Website unless expressly stated otherwise.

10. Force Majeure

10.1. No Party shall be deemed to be in default if the performance of obligations required by these terms and conditions is delayed or becomes impossible because of any act of God, war, fire, strike, other labour disturbance, technological or civil commotion or disruption, riots, epidemic or pandemic, acts of Government, its agencies or officers, or any other legitimate cause that is beyond the control of the Parties, is not due to any act or omission of the Parties, and is not due to a lack of funds or financing (“Force Majeure Events”).

10.2. Any Party claiming restrictions on the performance of any of its obligations under these terms and conditions due to an event or circumstance defined as a Force Majeure Event in Article 10.1 shall notify the other Party of the commencement and conclusion of such event or circumstance within five days of determining that a Force Majeure Event has occurred or ceased to occur. If any Party anticipates the occurrence of a Force Majeure Event, that Party shall promptly notify the other Party.

11. Product Description and Pricing

11.1. Each piece of jewellery purchased by you online is sold subject to its Product Description. The website will take reasonable care to ensure that all details, descriptions, and prices of jewellery displayed on the Website are correct when the relevant information is entered into the system. Although the website is kept as up to date as possible, information, including Product Descriptions appearing on the website at a particular time, may not always reflect the position at the exact moment you place an order.

11.2. Jewellery prices vary from one category or piece to another, and numerous factors, including the reputation of sellers, brand value, and jewellery design, may affect the price. The demand and supply of jewellery in the market may also affect jewellery prices. The prices stated on the Website may be substantially higher or lower than actual prices in retail markets.

11.3. Infrequently, data may be displayed inaccurately on the Website because of system errors. supernova-jewellery reserves the right to correct any and all errors when they occur, and the Company does not honour inaccurate or erroneous prices. While supernova-jewellery makes every effort to ensure that products are described and priced accurately, if an item is found to be priced incorrectly, supernova-jewellery reserves the right to refuse the sale of that item. Prices on the Website are also subject to change without notice. For any order, the price shall be the prevailing price on the date the order is confirmed. The prices of products listed on the Website are fixed and non-negotiable.

11.4. The website reserves the right to withdraw any jewellery or offer from this Website at any time and/or remove or edit any materials, pages, or content on the Website.

12. Advance/Part Payment

12.1. supernova-jewellery may, at its sole discretion, request the Member to pay a percentage of the transaction value as an advance when placing the order. The Member shall pay the balance amount for the order upon delivery of the product. Failure to pay the balance amount upon delivery shall be treated as cancellation of the order. Any advance amount paid by the Member while placing the order shall not be refunded by supernova-jewellery if the order is cancelled for any reason.

12.2. As a merchant, we shall not be liable for any loss or damage arising directly or indirectly from the decline of authorisation for any transaction because the Cardholder has exceeded their preset limit.

13. Electronic Communication

13.1. You agree that your use of the website for any purpose, including but not limited to sending communications via email or otherwise, information, or data, constitutes communication with the website through electronic records. You consent to receive communications through electronic records from the website periodically or as required. You accept that communication from the website through courier, post, or electronic means constitutes proper service of notice or electronic records.

14. Intellectual Property

17.1. If any clause or part of a clause of this agreement is found by a Court or Authority of competent jurisdiction to be invalid, unenforceable, or illegal, the other provisions shall continue to exist and remain in force.

18. Jurisdiction

18.1. By accessing this website, you agree that any action, suit, or other legal proceeding commenced to resolve any matter arising under or relating to the use of this Website shall be subject to the exclusive jurisdiction of the courts in Delhi.
